Who is responsible for data recording? The data processing on this website is performed by the website operator (Christine Kühne), whose contact details can be found in the Impressum.

3. Payment Processing via Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for these orders.

Data Processed: When you purchase a subscription, Paddle collects your name, address, email, and payment information.
Purpose: This is necessary for the fulfillment of the contract (Art. 6 Para. 1 lit. b GDPR).

4. Hosting on Hugging Face
Our application (the "Wrapper") is hosted on Hugging Face Spaces.

Data Processing: When you use the app, Hugging Face processes your IP address and server log files to ensure technical stability and security.
Data Transfer: Data may be processed on servers located in the United States. We ensure compliance via Standard Contractual Clauses (SCCs).

5. Processing of Business Data (Shopify/Ad Spend CSVs)

Purpose: We process the data you upload (sales and marketing spend) solely to execute the Marketing Mix Model (MMM) calculations.
Retention: As a privacy-first service, your uploaded CSV data is processed "in-memory." We do not store your raw Shopify transaction data in permanent databases unless explicitly requested for "Growth" or "Enterprise" customization.
Confidentiality: This data is treated as strictly confidential business information.

6. User Authentication (Hugging Face OAuth)
We use Hugging Face’s built-in OAuth for user login. We only receive the basic profile information (e.g., username/email) required to verify your subscription access. We do not receive your Hugging Face password.

7. Your Rights
Under the GDPR, you have the right to:

Request information about your stored data.
Request the correction or deletion of your data.
Object to data processing.
Data portability.

You retain all rights to the data you upload (Shopify/Ad Spend CSVs). We process this data solely to generate your MMM results. Data is processed in-memory where possible. For more details, see our Privacy Policy.
Limitation of Liability
Our models provide probabilistic estimates based on Bayesian inference. SmartStartApp is a decision-support tool. We are not responsible for any financial losses or business outcomes resulting from the use of the model.
Governing Law
These terms are governed by the laws of the Federal Republic of Germany.

Refund Policy

No-Refund Policy for Digital Services.
Due to the immediate access to our proprietary analytical tools and the high computational costs associated with initializing Bayesian models:

Final Sale:
All annual subscriptions (including the $1,200/year Starter Tier) are considered final once the first dataset has been uploaded and the model has been initialized.
Waiver of Withdrawal:
By clicking "Purchase," you expressly agree that SmartStartApp shall begin the performance of the service before the end of the statutory withdrawal period (where applicable). You acknowledge that your right of withdrawal is lost once the digital service has begun.
Technical Failure:
If a system error on our end prevents the generation of a report, and we cannot fix it within 7 business days, a prorated refund will be issued via Paddle.
Cancellation:
You may cancel your subscription at any time to prevent the next annual renewal. No partial refunds are provided for the remaining duration of a paid term.
